REGULATIONS OF THE ONLINE CATALOGUE OF ORDERS (the shop)
Introductory resolutions
1. This text constitutes regulations on the online catalogue of orders (the shop) run under the address www.klosok.com.pl. The operator of the shop is Firma Jubilerska Kłosok s.c. (the Jeweller's Company Kłosok, a civil partnership) with a seat in Rybnik. These regulations apply to the Seller and all the Customers making use of the services of this online shop.
2. Firma Jubilerska Kłosok s.c., in these regulations referred to as Seller, has an exclusive right to run the shop indicated above.
3. All products offered in the shop www.klosok.com.pl are brand new, free from all material and legal defects and they have been legally introduced to the Polish market.
4. All complaints pertaining to the method of providing services, resulting from ignorance of these regulations or from lack of their observance, shall not be considered.
5. The online catalogue of orders is designed to provide services for commercial contractors - jeweller's shops, wholesale companies, distributors.

Accepting an order
1. The online catalogue sells products via the Internet.
2. Completion of an order placed in weekdays after 5 p.m., on Sunday, Saturday or in a holiday begins on the first working day after placing the order.
3. Placing an order in the online shop means acceptance of these regulations.
4. Information pertaining to the products in the online shop www.klosok.com.pl does not constitute an offer as defined by the civil code but is an invitation to make a contract. By filling in an order form the Customer makes an offer of purchase of a particular product.
5. The Seller reserves the right to refuse completion of the order, to limit payment method and to demand an advance payment.
6. The photographs and other forms of visualization and presentation of the jewellery do not show its real size - they only function as information.
Warranty and certificates
1. All products offered in the shop are under warranty on defects of an object sold under the general rules or they are subject to the Seller's liability for lack of accordance of consumer goods with the contract (depending on which provisions apply in a particular case)*,

- an act on special conditions of consumer sale and on civil code change, dated 27 July 2002 (Law Journal 2002.141.1176 with later amendments)
Changes and withdrawal of the order
1. The Customer may make changes in the order or annul it until it is sent to be completed.
2. The Customer may enter remarks next to the ordered product, e.g. size, color and length of the stone etc. The Seller shall manufacture the ordered products in accordance with the Customer's remarks/description as far as possible.

4. An order in completion, already completed or sent may not be annulled.
Prices and weight of the products
1. All prices are given in PLN (Polish new zloty) without VAT or in Euros.
2. The price given next to each product is binding on placing the order by the Customer unless the Customer makes changes/modifications in the ordered product.
3. The presented weights of the products in grams are approximate and strictly depend on: weight and size of the stone, changes made by the Customer etc.
4. The presented values and sums of the order are approximate. The final value is always calculated on the basis of the actual order ready for shipment.
5. The basis for calculating the final value is the actual weight of finished products in grams.
6. The Seller reserves the right to change the product price in the case of significant differences in weight of the stones or in the case of modification of the product by the Customer.
7. All presented prices are basic wholesale prices.
8. The Seller reserves the right to change prices of the products in the offer, to introduce new products to the offer of the online shop, to conduct and cancel promotions on the web pages of the shop and to make changes in them.
9. Discounts up to 20% are given from the presented prices. The discounts are fixed individually, depending on the value of the order.
Invoices
1. Each completed order is accompanied by a VAT invoice.
Completion dates of the orders
1. The products are manufactured individually for each placed order. The time limit is 3 to 5 weeks. The ordered products are sent via a courier company.
2. All expenses connected with shipment within the borders of Poland are covered by the Customer.
3. Shipment abroad is executed only via a courier company. All expenses connected with shipment abroad are covered by the Customer. (the costs of such shipment are fixed individually in accordance with the forwarder's current price list).
4. The Seller is not liable for not completing the order on the fixed date for the reasons beyond the control of the Seller. Should there appear a cause preventing from completing the order within 3 to 5 weeks, the Seller shall immediately inform the Customer about it and shall give the expected time limit of completion. In such a case the Customer may withdraw the order.
5. Parcels delivered within the borders of Poland via a courier company should reach destination in the first working day after their posting.
Damage to the parcels
1. If the product is affected by mechanical damage of external origin, the Customer may not cite their warranty rights, their right to terminate the contract or any other right.
2. Before the Customer receipts the parcel, they are obliged to check if the packaging has been damaged in transportation. Special attention should be paid to the condition of wrapping tape.
3. If the packaging bears features of damage, the parcel must not be accepted. In such a case, the Customer is obliged to draw up a damage report in the presence of the courier or at a post office. The Customer must also as soon as possible (preferably immediately) contact Firma Jubilerska Kłosok s.c.; otherwise the goods will be considered delivered free from defects.
4. Checking the condition of the parcel is relevant to consider the Customer's claims on account of damage or theft of the parcel or is part during transportation.
Payment
– transfer of money to the shop's bank account. In the transfer's title please insert the number of invoice or number of order.
Return of the ordered goods
1. The Customer has no right to return the ordered goods, with an exception of goods with manufacturing defects.
Complaints
1. If defects of the product appear within 12 months after the date of purchase, in order to make a complaint on account of warranty the product must be sent to the company seat to the address:

with a note: REKLAMACJA - sklep internetowy (COMPLAINT - the online shop).
2. The complaint package must be accompanied by a photocopy of invoice and by a description of the defect on a separate sheet.
3. Delivery of the goods to the company seat is always at the Customer's expense.
4. Complaints are investigated free of charge. If defects being the producer's fault are detected, the product shall be repaired and sent back to the Customer at the shop's expense.
5. In case of detecting damage for which the Seller is not liable (damages being the Customer's fault or resulting from random incidents, especially mechanical damage, scratches and bending of the original shape of the jewellery), Firma Jubilerska Kłosok s.c. shall contact the Customer to inform them about possible costs of the repair.
Personal details protection
1. Under personal details protection act (ustawa o ochronie danych osobowych) dated 29 August (uniform text dated 6 July 2002 in: Law Journal 2002.101.926), the Seller undertakes to protect personal details.
2. By placing an order the Customer voluntarily agrees to the processing and using of their personal details to complete the order, consider complaints and facilitate placing the next order. These details are not processed or used for any other purpose.
3. The Customer has the right to access and correct their personal details, to demand ceasing of use of the details and to demand removal of the details.
4. The customer agrees to the processing of personal details for marketing purposes. At the same time, the Customer agrees to receive information connected with the company's offer and activity to the e-mail address or home address.
Final resolutions
1. These regulations come into force on 1 June 2008.
2. The regulations may be changed at any time. The changes do not affect negatively the user's rights and duties as regards services already being provided.
3. The changes in regulations come into force form the moment of their publishing in the online shop.
4. In issues not governed by these regulations, commonly binding legal provisions are applicable, especially: the civil code, act on special conditions of consumer sale and on civil code change, act on protection of selected rights of consumers and on liability for damage caused by a dangerous product.

6. Parties to the contracts made via the shop shall make every effort to reach amicable settlement of possible disputes arising from the application of these regulations, as well as from the content and execution of purchase contracts made between the parties.
7. A proper court to settle disputes is a court competent to deal with the case and appropriate for the place of the Seller's seat.
